BY SIGNING UP FOR ONE OR MORE OF LIPOCORE'S TEXT MESSAGING PROGRAMS, YOU AGREE TO ABIDE BY AND BE BOUND TO THESE LIPOCORE INC. SMS TERMS AND CONDITIONS. FURTHERMORE, THESE LIPOCORE INC. SMS TERMS AND CONDITIONS CONTAIN AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH AFFECTS HOW DISPUTES WITH LIPOCORE ARE RESOLVED.

By signing up for one or more text messaging programs, you expressly consent to receive marketing or non-marketing text messages, as applicable, from Lipocore and others texting on its behalf, at the telephone number(s) that you provide. You may opt out of these communications at any time. Consent to receive text messages is not a condition of any purchase.

Program Description

Lipocore text messages are intended to provide you with marketing and promotional information regarding Lipocore products and services, including product launches, exclusive offers, discounts, wellness tips, promotions, and order-related updates. We may also send transactional messages such as order confirmations, shipping notifications, and customer service communications.

Message Frequency

The number of Lipocore text messages you receive will vary depending on which Lipocore text messaging programs you enroll in and the frequency of messages associated with those programs.

Cost

Message and data rates may apply to each text message sent or received in connection with Lipocore text messages, as provided in your mobile service plan. Please contact your wireless carrier for pricing details. Lipocore does not charge a separate fee for sending text messages; however, you are responsible for any charges imposed by your mobile carrier.

How to Opt In

To receive text messages from a Lipocore text messaging program, follow the enrollment instructions provided. You may be asked to reply YES or another confirmation keyword to complete your subscription.

How to Opt Out

To stop receiving text messages from a specific Lipocore text messaging program, reply STOP to the phone number or short code from which the messages are sent. You may receive one final confirmation message acknowledging your opt-out request. After that confirmation, you will no longer receive messages from that specific program unless you opt in again.

Opting out of one messaging program does not automatically unsubscribe you from other Lipocore messaging programs you may have joined.

Your Mobile Telephone Number

You represent that you are the authorized account holder for the mobile telephone number(s) you enroll.

You agree to notify Lipocore promptly if your mobile telephone number changes. You may contact Lipocore Customer Support to update your information.

You agree to indemnify Lipocore for any claims, costs, damages, or expenses resulting from your failure to notify us of a change to your mobile telephone number, including claims arising under the Telephone Consumer Protection Act (TCPA).

Mobile Network Availability

It is your responsibility to ensure that your wireless carrier supports text messaging and that your mobile device is capable of receiving SMS messages.

Delivery of text messages depends on your wireless carrier and network availability. Lipocore is not responsible for delayed, undelivered, or misdirected messages or for issues arising from wireless carrier services.

Supported Carriers

Supported carriers may change over time but generally include major U.S. wireless providers such as:

• AT&T

• Verizon

• T-Mobile

• Sprint (where applicable)

• Boost Mobile

• Metro by T-Mobile

• U.S. Cellular

• Google Voice

Wireless carriers are not liable for delayed or undelivered messages.

Eligibility

To receive Lipocore text messages, you must:

• Be a resident of the United States.

• Be at least 18 years old (or the age of majority in your state).

Termination

Arbitration and Class Action Waiver

Any and all disputes, claims, demands, or causes of action between you and Lipocore, including its affiliates, employees, officers, directors, agents, successors, or assigns, shall be resolved exclusively through confidential, binding arbitration, except where either party may bring an eligible claim in small claims court.

Each party also retains the right to seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
